Parties Involved
This contract is between
1. MOMENTUM DYNAMICS SDN BHD company with company registration number 202501008915 (1610329-H) (“Seller”) and
2. Member of MOMENTUM DYNAMICS SDN BHD Bookstore identified by his/her email address (“Buyer”)
Collectively known as “Parties” to this contract
“Site” refers to Seller’s website located at https://momentumdynamics.store/
Order Acceptance Policy
The receipt of an e-mail order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. Seller reserves the right, without prior notification, to limit the order quantity on any item and/or refuse service to any Buyer. Verification of information may be required prior to the acceptance of any order.
Order Cancellation Policy
Buyer cannot cancel an order (or part of an order) after payment has been made.
Exchange Policy
Once a product has been sold, it cannot be exchanged except:
1.Product received is different from what is being purchase (wrong goods are delivered)
2.Product received is reasonably damaged
3.Product received is different from what is described by our website
Buyer has the right to exchange a purchased, eligible product if a claim is made within 3 working days from the day the product is received. Seller has the right to refuse such claim if made after this 3-day period.
Governing Law
These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from or relating to the use of the website of these terms will be subject to the exclusive jurisdiction of the courts in Malaysia.
Pricing Policy
Seller reserves the right to make adjustment to any published price of any product due to input error, product discontinuation, and stock clearance, under the instruction of manufacturers and distributors, and errors in advertising.
Delivery and Receiving of Orders (for Office and Home Delivery)
Seller’s contracted couriers will attempt to deliver purchased products to Delivery Address supplied by Buyer. If nobody is at the address to pick up the delivered products, couriers will leave a Delivery Note and Buyer can call couriers’ call centre to arrange free re-delivery.
Seller reserves the right to impose additional delivery charge should Buyer furnished Seller with a wrong or invalid delivery address or failed to contact Seller’s couriers for re-delivery arrangement within 2 weeks from the date of first attempted delivery.
Accuracy of Information
Seller attempts to be as accurate as possible when describing Seller’s products on the Site; however, to the extent permitted by applicable law, Seller do not warrant that the product descriptions, colors or other content available on the Site are accurate, complete, reliable, current, or error-free.
Indemnification
Buyer agrees to defend, indemnify and hold Seller harmless for any loss, damages or costs, including reasonable attorneys’ fees, resulting from any third party claim, action, or demand resulting from Buyer’s use of the Site including purchase of products.
Disputes
With respect to any dispute regarding the Site, all rights and obligations and all actions contemplated by these Terms of Sale shall be governed by the laws of the Republic of Malaysia, as if the Terms and Sale were a contract wholly entered into and wholly performed within Malaysia.
General
Seller reserves the right, in our sole discretion, to change these Terms of Sale at any time by posting the changes on the Site. Any changes are effective immediately upon posting to the Site.
